§ 1 Scope of application

These General Terms and Conditions ("GTC") apply to contracts that you conclude with us, TradeSpot AG, Petersplatz 3, 4051 Basel (+41784081860, [email protected]) ("myvizualshop") via our online store at www.myvizualshop.com. Our online store is aimed exclusively at consumers. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor their independent professional activity.

§ 2 Contract conclusion, contract text storage

We conclude contracts exclusively in German language. The product descriptions contained in our online store do not represent binding offers from us, but serve for the submission of a binding offer by you. You can submit your offer via the order form integrated in our online store. After you have placed the selected goods in the virtual shopping cart and have gone through the electronic ordering process, you submit a legally binding offer with regard to the goods contained in the shopping cart by clicking on the button "Order subject to payment" which concludes the ordering process. We can accept your offer within five days by sending you a written order confirmation or an order confirmation in text form (fax or e-mail), whereby the receipt of the order confirmation by you is decisive, or by delivering the ordered goods, whereby the receipt of the goods by you is decisive, or by requesting payment after placing your order. If there are several of the aforementioned alternatives, the contract shall come into effect at the time when one of the aforementioned alternatives occurs first. The period for acceptance of the offer begins on the day after the dispatch of your offer according to paragraph 3 and ends with the expiry of the fifth day following the dispatch of the offer. If we do not accept your offer within the aforementioned period, this shall be deemed a rejection of your offer with the consequence that you are no longer bound by your offer. We will immediately confirm your order in text form to your specified e-mail address. The contract text will be sent to you with the order confirmation. We will not make the contract text accessible beyond this. If you have set up a customer account with us before sending your order, we will archive your order data. You can retrieve these order data via your password protected customer account by entering your login data.

§ 3 Legal right of revocation

Cancellation policy / Right of cancellation

You have the right to cancel this contract within fourteen days without giving reasons. The revocation period is fourteen days from the day on which you or a third party designated by you, who is not the carrier, have taken or has taken possession of the goods. In order to exercise your right of revocation, you must inform us (TradeSpot AG , Petersplatz 3, 4051, Basel, [email protected]) by means of a clear declaration (e.g. a letter, fax or e-mail sent by post) of your decision to revoke this contract. You may use the attached sample revocation form for this purpose, but this is not mandatory. In order to comply with the revocation period, it is sufficient that you send the notification of the exercise of the right of revocation before the end of the revocation period.

Consequences of revocation

If you revoke this contract, we must refund all payments we have received from you, including delivery costs (with the exception of additional costs resulting from the fact that you have chosen a different type of delivery than the cheapest standard delivery offered by us), immediately and at the latest within fourteen days from the day on which we receive notification of your revocation of this contract. For this refund, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you. Under no circumstances will you be charged for this refund. We may refuse to refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever is earlier. You must return or hand over the goods to us immediately and in any case within fourteen days at the latest from the day you notify us of the cancellation of this contract. This period shall be deemed to have been observed if you send the goods before the expiry of the fourteen-day period. The direct costs of returning the goods shall be borne by you. You will only have to pay for any loss of value of the goods if this loss of value is due to a handling of the goods that is not necessary for testing the condition, properties and functionality of the goods.

§ 4 Purchase price, shipping costs

The prices listed in the respective product description at the time of the order shall apply. The stated prices are final prices. This means that they include the applicable German statutory value added tax. If the value of goods is less than 30.00 CHF per order, the shipping costs are 4.20 CHF per order. With a value of goods from 30,00 CHF the shipping is free of charge.

§ 5 Payment types

In our store you can choose between the payment types "credit card" (Visa and Mastercard), "PayDirect", direct debit and purchase on account. If you choose the payment method "credit card", your credit card account will be charged upon completion of the payment process.

§ 6 Discount codes

Discount codes are issued as part of advertising campaigns. Discount codes are only redeemable during the order process in the virtual shopping cart under "Apply discount code". They can only be redeemed before the order process is completed. A subsequent crediting is not possible. Several promotion vouchers cannot be combined with each other. Discount codes can be bound to a certain period of validity. Individual products may be excluded. Discount codes can be bound to a minimum order value. The order value must be at least the value of the discount code. A difference to a higher value of goods can be compensated with the offered payment options. The value of a discount code is neither paid out in cash nor does it bear interest. The value of a discount code will not be refunded if goods are returned in whole or in part. The discount code cannot be transferred to third parties. If you have used a discount code when making your purchase, we reserve the right to charge you the original price of the goods that you keep if - due to your cancellation - the total value of the order falls below or equals the value of the discount code.

§ 7 Delivery

The delivery of the ordered goods is carried out by dispatch to the delivery address indicated by the customer. We only deliver to delivery addresses in Switzerland. The delivery time is indicated in the respective product description. The collection of the ordered goods is not possible for logistical reasons.

§ 8 Reservation of title

The goods remain our property until full payment of the purchase price.

§ 9 Warranty

The statutory liability for defects shall apply.

§ 10 Settlement of disputes

The European Commission provides an online dispute resolution (OS) platform, which you can find at the following link: www.ec.europa.eu/consumers/odr This platform serves as a contact point for the extrajudicial settlement of disputes arising from online purchase or service contracts in which a consumer is involved. We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
